1. Acceptance of Terms

By creating an account, accessing, or using PepMetrics, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use PepMetrics.

2. Description of Service

PepMetrics is a personal wellness tracking tool that allows you to:

• Track peptide protocols and dose schedules
• Log doses with one-tap logging
• Integrate with Apple HealthKit (iOS) and Google Health Connect (Android) to read heart rate, HRV, sleep, steps, and weight data
• View AI-powered pattern detection and insights
• Use fasting timers and progress tracking features
• Work offline with sync when connected

Age Requirement

You must be at least 18 years of age to create an account and use PepMetrics. By using PepMetrics, you represent and warrant that you are at least 18 years old.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Accurate Information

You agree to provide accurate and complete information when creating your account and to keep this information up to date.

You agree to use PepMetrics only for lawful purposes and in accordance with these Terms. You agree not to:

• Use PepMetrics for any commercial purpose without our prior written consent
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reverse engineer, decompile, or disassemble any part of PepMetrics
• Use PepMetrics to transmit malware or other harmful code
• Interfere with or disrupt the operation of PepMetrics
• Use PepMetrics in any way that violates applicable laws or regulations

6. AI Features Disclosure

PepMetrics includes AI-powered features that analyze patterns in your tracking data to provide insights. You acknowledge and agree that:

• AI-generated insights are for informational purposes only and are not medical recommendations
• Insights reflect "patterns observed" in your data, not prescriptive advice
• AI outputs may contain errors or inaccuracies
• You should not rely solely on AI insights for health-related decisions
• We send only anonymized protocol timing patterns to our AI provider — never raw health values or personally identifiable information

7. Intellectual Property

PepMetrics, including its design, features, content, and code, is owned by Digital VisionWorks LLC and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the data you enter into PepMetrics. We do not claim any intellectual property rights over your personal health data, protocols, or other content you create within the app.

8. User Content

You are solely responsible for the accuracy and completeness of the data you enter into PepMetrics, including protocol information, dose logs, and notes.

By using PepMetrics, you grant us a limited license to store, process, and display your data solely for the purpose of providing the service to you. We will not use your personal data for any other purpose without your consent.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information and health data. By using PepMetrics, you consent to the practices described in our Privacy Policy.

10. Disclaimers and Limitation of Liability

"As Is" Disclaimer

PEPMETRICS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Liability for Health Decisions

We are not liable for any health-related decisions you make based on information displayed in PepMetrics. You use the app at your own risk and are solely responsible for your health decisions.

Limitation on Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL VISIONWORKS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF PEPMETRICS.

11. Indemnification

You agree to indemnify, defend, and hold harmless Digital VisionWorks LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or related to your use of PepMetrics, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

You may terminate your account at any time by following the account deletion process in the app or by contacting us. We may suspend or terminate your access to PepMetrics at any time for any reason, including if we believe you have violated these Terms.

Upon termination, you may request an export of your data before deletion. After account deletion, your personal data will be permanently removed from our systems within 30 days, as described in our Privacy Policy.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or your use of PepMetrics shall be resolved through good-faith negotiations. If a resolution cannot be reached, disputes shall be submitted to binding arbitration in Florida in accordance with the rules of the American Arbitration Association.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you through the app or by email where appropriate. Your continued use of PepMetrics after changes are posted constitutes your acceptance of the revised Terms.

15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Digital VisionWorks LLC regarding PepMetrics.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
• Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms at any time without notice.
